Privacy Policy

This page explains how Gamification State, LLC (“Gamification State,” “we,” “us,” or “our”) handles information for the Instructor Dashboard and related services. When a U.S. school uses our services, we act as a School Official under FERPA and process Student Education Records at the School’s direction. For instructor accounts and our own operations, we act as an independent controller .

1) What We Collect

• Instructor & school admin data name, email, password hashes, institution, role, settings, and support messages.
• Class & usage data class codes, instructor actions, timestamps, device/log info (e.g., IP, browser, OS), and diagnostics.
• Student Education Records (at School direction) student identifiers (school‑issued or pseudonyms), class membership, progress, assignment results, responses, and app events.
• Cookies/local storage used only for authentication, security, sessions, and features — not advertising.

2) How We Use Information

• Provide & secure the service authentication, sessions, dashboards, and analytics.
• Show individual and aggregate progress for instructional purposes.
• Support FERPA requests by assisting Schools with access, correction, or deletion.
• Improve features using aggregated or de‑identified data.
• Communicate service notices and respond to support.
• Comply with law and enforce our Terms.

We do not sell Student Education Records and we do not use them for targeted advertising . We also do not advertise to children or show ads to students.

3) Sharing

• Service providers/subprocessors (hosting, auth, email, analytics/AI where applicable) under contracts limiting use to our instructions.
• The School and authorized personnel for educational purposes.
• Legal/safety if required by law or necessary to protect rights and security. In a merger or acquisition, we will provide notice where required.

Student Education Records are disclosed only as a School Official, at the School’s direction, or as required by law.

4) Rights & Choices

• FERPA (parents/eligible students) submit requests to your School; we assist the School.
• Instructor account changes update certain details in the Dashboard or contact us.
• Marketing preferences instructors may opt out of non‑essential messages; we do not send marketing to students.

5) Security, Retention, and Incidents

• Safeguards encryption in transit, access controls, logging, and periodic reviews.
• Retention instructor data is kept while the account is active and as needed to provide the service.
• Deletion of Student Education Records upon verified School request or contract end, we delete or de‑identify in active systems within 30 days and from backups within 90 days unless law or the School requires otherwise.
• Incident notice if a security incident affects Student Education Records, we will notify the School without unreasonable delay and within 10 business days after confirmation, with information needed for legal obligations.

6) Children’s Privacy

We do not knowingly collect personal information directly from children through the Instructor Dashboard. Student data is provided by or at the direction of the School. We do not advertise to children and we do not use Student Education Records for behavioral ads.

7) Changes & Contact

Updates we may change this policy and will post updates here and adjust the Effective Date. Material changes may be announced in‑product or by email.
